SB9 and SB10....'Stop the Sacramento Land Grab' Initiative....HHR (and many Ca. cities) Sue SB10 as Unconstitutional
SB 9 and SB10 were signed by Governor Newsom.
SB9.... ….will soon become Law.
It takes away local control and eliminates single family zoning across the state.
SB10.... ….Not only takes away local control, and allows ten unit buildings in single family communities, but gives electeds, city councils, the power to override Voter Initiatives.
There are law suits being filed regarding the Unconstitutionality of SB10 Overriding Voter Initiatives..
Both bills take away local control, hand it over to the state, and take away community participation in the more dense, upzoned development that will be allowed in their neighborhoods..

Livable California Endorses the “Stop the Sacramento Land Grab Initiative”
The purpose of this measure is to ensure that all decisions regarding local land-use controls, including zoning regulations, are made by the affected communities in accordance with applicable law.
If passed by California voters, this initiative would give communities the ability to undo the damage caused by bills like SB 330, SB 35, SB 9 and SB 10.
It will overturn land use bills that take away local control, retroactively.
Status of the proposed initiative: The proponents have changed the name of the initiative from “Californians for Community Planning” to “Stop the Sacramento Land Grab” The initiative was filed on 8/25 and is in a 30-day comment period. Within 6 weeks, the Attorney General will then issue a title and ballot summary. Then, the proponents have 180 days to gather 1.3M signatures to qualify for the 2022 ballot. Councilmember Koretz (CD5) Supports HHR/AHF SB10 Lawsuit.....
This week, Councilmember Koretz joined AIDS Healthcare Foundation and Housing Is a Human Right at a press conference to announce the filing of a lawsuit asserting that California Senate Bill 10, that was signed into law this month by Governor Newsom, violates the California Constitutional Right of Initiative by allowing local elected officials to override Zoning Restrictions established by Local Initiative or disregard Initiative Measures put in place by the voters.
The complaint, (Case No. 21STCP03149) challenges the Constitutionality of a provision in the bill intended to streamline the process for cities to zone for multi-unit housing.
Councilmember Koretz has been working to daylight the dangers of SB 9 and 10 and was able to keep several versions of the bills from passing the State Legislature and even led the City Council in providing overwhelming opposition.
Even though surveys showed that 71% of voters opposed SB9 & 75% opposed SB10, both pieces of legislation eventually passed and were signed by the Governor last week -- but not before Councilmember Koretz sent a strongly-worded letter asking him to veto both bills, noting that the seriously detrimental intrusion on local control these bills represent may very well upend the substantial work the City has undertaken to effectuate a voter-approved measure (Measure JJJ) to increase the City’s stock of affordable housing.
The letter further points out the wide array of shortcomings both of the bills have in comparison to a variety of affordable housing programs that are in process in the City of Los Angeles as well as the myriad of negative environmental impacts the bills will have on the City if signed into law.
